1. Who we are

This website, pickhavenn.com, and the Pick Havenn store are operated by Thang Nguyen Duy, 12 Princes Street, Turramurra NSW 2074, Australia ("Pick Havenn", "we", "us"). Using this site or placing an order means you accept these terms.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract, and you must give a delivery address in a country our carrier serves. It is your responsibility to make sure the goods may lawfully be imported into your country.

3. Orders and acceptance

Your order is an offer to buy. A contract is formed only when we send a dispatch confirmation. We may decline or cancel an order before dispatch — for example if an item is unavailable, a price or description was wrong, or the order fails a fraud check — and we refund it in full when we do.

4. Prices and availability

Prices are in USD and may change without notice, but the price you paid at checkout is the price of your order. Listed stock figures are the figures supplied to us by our manufacturing partner and are not a guarantee that an item can be produced; if an item you ordered cannot be supplied, we tell you and refund it.

5. Brand independence

The boots we sell are unbranded factory styles supplied by our manufacturing partner and sold under our own store name. Pick Havenn is not affiliated with, endorsed by, sponsored by, or an authorized reseller for any footwear brand, designer or retailer. Where a style term such as "Chelsea", "Chelsea boot", "cowgirl boot", "combat boot" or "gogo boot" appears, it describes a shape of boot, not a maker.

6. Product descriptions, colors and images

We describe every product as accurately as we can from the information and photographs our manufacturing partner supplies. Colors shown on your screen will differ from the boot in daylight, and stated heel heights and shaft heights are the manufacturer's figures, quoted on a single sample size. Minor variation between pairs is normal in footwear. Descriptions are not a warranty of anything beyond the goods being as described.

7. Shipping, returns and refunds

Our Shipping Policy and Refund & Returns Policy form part of these terms. Delivery timeframes are estimates, not guarantees. Risk passes to you on delivery.

8. Acceptable use

Do not scrape, copy or republish this site's content, attempt to break its security, place fraudulent orders, or use the site for anything unlawful.

9. Intellectual property

The Pick Havenn name, this site's text, layout and design are ours or licensed to us. Product photographs are supplied by our manufacturing partner and used with permission. Nothing here transfers any right to you beyond viewing the site and buying from it.

10. Third-party links

Links to other sites are provided for convenience. We do not control them and are not responsible for their content or their privacy practices.

11. Disclaimers and limitation of liability

To the fullest extent permitted by law, the site and the products are provided without warranties beyond those that cannot be excluded under applicable law, including your rights under US state consumer protection laws. Our total liability arising out of any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, or for delays caused by events outside our control such as customs action, carrier disruption, severe weather or industrial action.

12. Indemnity

You agree to hold us harmless from claims arising out of your breach of these terms or your misuse of the site.

13. Governing law

These terms are governed by the laws of New South Wales, Australia. Nothing in this clause removes a right you have under the mandatory consumer protection law of the US state in which you live, including your right to bring a claim there.

14. Changes

We may update these terms. The version in force is the one published here on the day you order, and the "last updated" date above tells you when it changed.
